white-space: normal;">2018年5月,原告购买上海市浦东新区临港嘉和XX小区XX号XX室房屋,并与被告签订《上海市商品房预售合同》,房屋总房款暂定300余万元。根据合同第十条约定,该房屋的交付必须符合所列条件:取得了《住宅交付使用许可证》;甲方对该房屋设定的抵押已注销;甲方已按规定缴纳了物业维修基金;甲方承诺在2019年10月31日前办理房地产初始登记手续,取得新建商品房房地产权证(大产证),如到时不能取得大产证,乙方有权单方面解除本合同。合同第十一条约定,甲方定于2019年4月30日前将该房屋交付给乙方,除不可抗力外。第十二条约定,甲方如未在合同第十一条约定期限内将该房屋交付乙方,应当向乙方支付违约金,违约金按乙方已支付房价款的日万分之一计算,违约金自本合同第十一条约定的最后交付期限之第二天起算至实际交付之日止,逾期超过90天,乙方有权单方面解除合同。后原告按约付清了购房款。 现交房时间早已经到了,但是被告至今未能交房。交房时间一拖再拖,被告分别于2019年-2021年,四次向原告等业主发出逾期交房通知。 同时,按照合同约定被告应在2019年10月31日前取得大产证,但被告至今仍未取得。原告认为,被告延迟交房的行为,违反合同约定,给原告造成了巨大的经济损失,被告至今未能办理大产证,更导致原告逾期取得小产证,故原告要求被告按照合同约定支付逾期交房、小产证违约金等共计35万元。</p><p style="box-sizing: border-box; white-space: normal;">1.关于逾期交房违约责任的问题。疫情以来,很多开发商因为资金等各项问题可能出现不同原因逾期交房。但是依法成立的合同,对当事人均具有法律约束力,当事人应当按照约定履行自己的义务。双方在预售合同中已明确约定被告交房时间及逾期交房的违约金标准,故本案被告应按合同约定万分之一标准支付原告逾期交房违约金。</p><p style="box-sizing: border-box; white-space: normal;">2.关于未及时办理小产证的违约责任问题。被告在庭审中虽认可应支付逾期交房违约金,但却认为逾期交房违约金和未及时办理小产证的违约金同时计算过高,且对计算时间不认可。根据合同约定,被告本应于2019年10月31日前办出涉案房屋的大产证,取得大产证后90日内双方签署《房屋交接书》,签署《房屋交接书》之日起90日内办理申请小产证等手续,但被告至今未办出大产证,致原告办理小产证的时点晚于约定期限,被告对此确实也构成违约,应当承担相应的违约责任。由于对于逾期办理小产证违约损失的计算标准,原预售合同里并未作约定,根据相关司法解释的规定,合同没有约定违约金或者损失数额难以确定的,可以按照已付购房款总额,参照中国人民银行规定的金融机构计收逾期贷款利息的标准计算。</p><p style="box-sizing: border-box; white-space: normal;">4.开发商逾期交房解决办法。首先,先与开发商进行协商。在协商过程中注意维权方式的合法性,不能采取过激行为,更不能采取围堵等扰乱公共秩序的行为。否则,是违法的行为。其次,可以通过法律途径,向法院起诉。由于开发商逾期较长的情况下,违约金非常高。很多开发商一般不愿意主动支付高昂的违约金。这里荆华律师建议,若是和开发商协调不成,可以直接向法院提起诉讼,按合同要求开发商赔偿自己的损失。再次,关于逾期交房时间过长,解决的最终方法,除了要求开发商继续履行合同,承担违约责任外,购房者同样也可以主张解除房屋买卖合同,要求返还购房款并主张经济损失。至于最终采取哪一种维权的方法对自己最有利,可以先提前咨询或委托律师处理。荆华律师在接受委托后,一般会先发律师函或催告函给开发商。看双方有没有协商的可能性。本文仅为笔者律师在处理类似案件的一些观点和建议,仅为参考。如投资者遇到实际法律纠纷问题,也可以直接将情况反馈给律师v 1044217847,以获取更有针对性的建议和方案。</p><p style="box-sizing: border-box;
